Terms of Service

Effective date: 17 August 2026  |  Last updated: 17 August 2026

These terms govern your use of the services provided by AI Sorted (Pty) Ltd. Please read them before you start using the Service. By using the Service you agree to them.

1.Who we are

The Service is provided by AI Sorted (Pty) Ltd, registration number 2026/353444/07, a company registered in South Africa, with its address at 225 Willson Street, Fairland, Randburg, Gauteng, 2170. In these terms, "we", "us" and "our" mean AI Sorted (Pty) Ltd, and "you" means the business that has signed up for the Service and the people it authorises to use it.

2.What the Service does

AI Sorted provides business messaging automation for small and medium South African businesses, primarily trades and service businesses. A staff member sends a job description to a WhatsApp business number, by text or voice note. We interpret that message, read the request back for confirmation, and create a draft quotation in your own accounting system using your rate card. The quotation is returned to the sender on WhatsApp.

The Service is provided for business use only. It is not intended for consumers or for personal use.

3.Your account

You are responsible for the accuracy of the details you give us, including the mobile numbers you authorise to send quotation requests and the rate card we bill from. Only numbers you have authorised can use the Service on your account. You must tell us promptly when a staff member leaves or a number should no longer have access, and you are responsible for activity on your account until you do.

The person who accepts these terms confirms that they are at least 18 years old and are authorised to bind the business.

4.Acceptable use

You agree that you will not use the Service to:

Because the Service runs on the WhatsApp Business Platform, you must also comply with Meta's WhatsApp Business Messaging Policy and the WhatsApp Business Terms of Service. Meta may suspend or restrict a business phone number for breaches of its policies, and we cannot override that.

5.Third-party services

The Service depends on third parties, including Meta (WhatsApp Business Platform), Google (hosting and language processing), and your accounting provider, such as Xero. Your use of those services is governed by their own terms, and their availability, pricing, and policies are outside our control. We are not responsible for a third party's outage, policy change, or account action.

6.Fees, billing, and cancellation

Fees are those set out in the plan you signed up for, billed monthly in South African Rand. Unless we state otherwise, prices exclude VAT, which we add where it applies. Fees charged by third parties, including Meta's per-conversation messaging charges, are separate and may be billed to you by that third party directly.

You may cancel at any time with one calendar month's notice, effective at the end of the following billing month. Fees already paid are not refundable for a part month. We may suspend the Service if an invoice is more than 30 days overdue, after telling you first.

7.Availability and support

We aim to keep the Service running reliably, but we do not promise that it will be uninterrupted or error free. We may take the Service down for maintenance, and we will give reasonable notice where we can. Support is provided by email and WhatsApp during South African business hours.

8.Your data

You keep ownership of your business data, including your customer details, rate card, and the quotations produced. We process personal information as described in our Privacy Policy, which forms part of these terms. We use your data to provide and improve the Service to you. We do not sell your data.

You can ask us to delete your data at any time. See our data deletion instructions for how to do that and what happens next.

9.Accuracy of quotations

The Service produces draft quotations from the information in your message and the rate card on your account. Drafts are a starting point, not professional advice, and they are not sent to your customer automatically. You remain responsible for checking a quotation before you rely on it or send it on. We are not liable for a pricing error in a quotation you approved.

10.Intellectual property

We keep all rights in the Service, including its software, interfaces, and documentation. Nothing in these terms transfers those rights to you. You may use the Service for your own business for as long as your account is active.

11.Limitation of liability

Nothing in these terms limits liability that cannot be limited by law, including liability for fraud or for death or personal injury caused by negligence. Subject to that, we are not liable for indirect or consequential loss, or for loss of profit, revenue, goodwill, or anticipated savings. Our total liability to you in any twelve month period is limited to the fees you paid us for the Service in that period.

12.Suspension and termination

We may suspend or end your access if you materially breach these terms, if your use puts the Service or another customer at risk, or if a third-party platform requires it. Where it is reasonable to do so, we will tell you first and give you a chance to put things right. On termination we will, on request, give you a copy of your data in a common format, and then delete it as described in our data deletion instructions.

13.Changes to these terms

We may update these terms, for example when the Service or the law changes. The current version is always on this page, with the "Last updated" date at the top. We will tell you about material changes before they take effect. Continued use of the Service after that means you accept the updated terms.

14.Governing law

These terms are governed by the law of the Republic of South Africa. The parties submit to the jurisdiction of the High Court of South Africa, Gauteng Division, Johannesburg.
