Qwill Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of Qwill, a digital maths practice product, and any purchase you make through the Qwill website and application ("Qwill", "the Service"). Please read them carefully. By creating an account, making a payment, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1.Who we are

Qwill is owned and operated by:

Qwill is a product line of AI Sorted (Pty) Ltd. References to "Qwill" mean the product; the contracting party is AI Sorted (Pty) Ltd.

2.What Qwill is

Qwill provides bilingual (English and Afrikaans) maths practice tests and quizzes for school learners, organised by grade, term, and topic, aligned to the South African CAPS curriculum. The Service is delivered digitally, online, through the Qwill website and application.

Qwill is a practice and revision tool. It is provided to support a learner's maths practice. We do not guarantee any particular academic result, mark, or outcome from using it.

3.Eligibility and accounts

Qwill is sold to parents, guardians, and other adults purchasing for the use of a child in their care. You must be at least 18 years old and legally able to enter into a contract to make a purchase.

Where the Service is used by a child, you confirm that you are the parent or guardian (or have the consent of the parent or guardian) and that you consent, as the competent person, to the child's use of the Service and to the processing of the child's personal information as described in our Privacy Policy and in line with the Protection of Personal Information Act, 2013 (POPIA).

You are responsible for keeping your account login details secure and for all activity that takes place under your account. Please notify us promptly at dean@aisorted.co.za if you believe your account has been used without your permission.

4.Pricing and payment

Prices for Qwill are shown on the Qwill website at the point of purchase, in South African Rand (ZAR). The price displayed at checkout is the price you pay.

Qwill is sold as a once-off purchase. You pay a single fee to receive access to the content described at the point of sale. This is not a subscription, and you will not be billed on a recurring basis for that purchase.

Payments are processed securely by Payfast (Payfast by Network), a registered South African payment gateway. We do not receive or store your full card details. Your use of Payfast to make a payment is also subject to Payfast's own terms and privacy policy.

Your purchase is complete once Payfast confirms that your payment has been received. We reserve the right to decline or cancel a transaction where payment cannot be verified or where we reasonably suspect fraud or error.

5.Delivery and access

Qwill is digital. Access is provided online, through your account, immediately or as soon as reasonably possible after Payfast confirms your payment. There is no physical product to ship.

If you do not receive access after a successful payment, contact us at dean@aisorted.co.za and we will resolve it.

To use the Service you need a compatible device and a working internet connection. These are your responsibility and are not provided by us.

6.Refunds, returns and cancellation

Qwill is a digital product, and once you have been given access to the purchased content, the sale is final and no refunds are given.

You expressly request and consent to immediate access to the digital content on payment. You acknowledge that, by accessing the content, you forfeit any cooling-off right that would otherwise apply to the supply of digital content under the Electronic Communications and Transactions Act, 2002 (ECTA). The seven-day cooling-off right under ECTA does not apply once performance has begun with your consent, which includes accessing or starting to use the digital content.

This clause does not limit any right you may have under the Consumer Protection Act, 2008 (CPA) to a refund or remedy where content is faulty, not as described, or not fit for its intended purpose. If something is genuinely wrong with what you bought, contact us at dean@aisorted.co.za and we will investigate and put it right, which may include restoring access, replacing the content, or refunding you, as appropriate.

Refunds for payments received in error, or for duplicate charges, will be made to the original payment method, normally within 30 days of us confirming the error.

7.Acceptable use and licence

On purchase, we grant you a personal, non-exclusive, non-transferable licence to access and use Qwill for the private, non-commercial educational use of the learner in your household for whom it was bought.

You may not:

We may suspend or terminate your access if you breach these Terms, without refund where the breach is material.

8.Intellectual property

All content in Qwill, including the questions, answers, explanations, visuals, layout, branding, and software, is original work owned by AI Sorted (Pty) Ltd or its licensors, and is protected by South African and international intellectual property law. Buying access to Qwill does not transfer any ownership of that content to you. All rights not expressly granted to you in clause 7 are reserved.

9.Availability and changes to the Service

We aim to keep Qwill available and working, but we do not promise that it will always be uninterrupted, error-free, or available at any particular time. We may carry out maintenance, update content, or change features from time to time. We may also add to, improve, or correct the content you have access to.

10.Limitation of liability

To the maximum extent allowed by law, and subject to your rights under the CPA:

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability under the CPA.

11.Privacy and personal information

We process personal information in line with POPIA and our Privacy Policy, which forms part of these Terms. The Privacy Policy explains what we collect, why, how we keep it secure, and your rights, and it includes how we handle the personal information of children. By using Qwill you confirm that you have read the Privacy Policy.

12.Changes to these Terms

We may update these Terms from time to time, for example to reflect changes to the Service or to the law. The current version will always be available on the Qwill website, with the "Last updated" date shown at the top. Material changes will take effect when posted, and your continued use of the Service after that means you accept the updated Terms.

13.Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from them or from your use of the Service is subject to the jurisdiction of the South African courts.

If you have a complaint, please contact us first at dean@aisorted.co.za so we can try to resolve it directly. Your rights to refer a matter to the relevant ombud or regulator, including under the CPA, are not affected.
